These Terms apply to:
Garagaty (Customer/User App): garages, categories, auctions (where available), advertisements, browsing and interacting with listings.
Garagaty Partners (Partner App): creating/managing auctions, bidding workflows (as applicable), promoting garages, managing business profiles and listings.
You must be at least 18 years old to use the Service. By using the Apps, you confirm you meet this requirement and have legal capacity to enter into these Terms.
You may need an account to use certain features.
You are responsible for keeping your login credentials secure.
You agree to provide accurate information and keep it updated.
We may suspend or terminate accounts that appear fraudulent, abusive, or in violation of these Terms.
Garagaty is a platform that helps:
Customers discover garages and services.
Businesses/partners list and promote their services.
Users and partners create and participate in auctions (where enabled).
Important: We are a platform provider. Unless explicitly stated, we are not a party to transactions between users and businesses/partners.
You may post content such as business details, advertisements, auction listings, images, pricing, and descriptions (“Content”).
You agree that:
You own the Content or have permission to use it.
Your Content is truthful, accurate, and not misleading.
Your Content does not violate any law or third-party rights (IP, privacy, etc.).
By posting Content, you grant us a non-exclusive, worldwide, royalty-free, transferable license to host, store, reproduce, modify (for formatting), display, and distribute your Content for operating and promoting the Service.
We may (but are not required to) review, remove, restrict, or disable Content that violates these Terms, is misleading, or is harmful.
If you use auctions/bidding features, you agree to these rules:
Accuracy: Auction creators must provide accurate item/service details, photos, and conditions.
Bids: Bids should be genuine. Fake bids, manipulation, and collusion are prohibited.
Availability: Auction creators must honor the auction outcome (subject to any stated terms/availability).
Disputes: Disputes between users and partners should be resolved between them first. We may assist by reviewing platform logs, but we do not guarantee outcomes.
Fees: If the Service charges fees (for promotions, listings, or auctions), such fees will be shown inside the app or admin settings.
We may add additional auction rules inside the App or Admin panel, and those rules become part of these Terms.
Users/partners may post advertisements subject to our rules and approval process (if any).
We may reject, limit, or remove any advertisement at our discretion (e.g., prohibited content, misleading claims, policy violations).
Promotions may be time-limited and subject to availability.
Some features may be paid (e.g., promoted listings, ads, premium placement).
Prices, taxes (if any), and payment terms will be shown before purchase.
Payments may be handled by third-party payment processors.
Refunds, if offered, will follow the refund policy displayed in the App/Admin or required by applicable law. If no refund policy is stated, purchases may be non-refundable except where required by law.
You agree not to:
Use the Service for illegal purposes.
Post false, misleading, defamatory, or offensive content.
Infringe intellectual property or privacy rights.
Attempt to hack, reverse engineer, disrupt, or overload the Service.
Use bots/scrapers without permission.
Manipulate auctions (fake bids, bid shielding, collusion).
Harass, threaten, or abuse other users/partners.
Create multiple accounts to bypass restrictions.
The Apps, logos, UI, text, graphics, and software are owned by Garagaty or its licensors and are protected by applicable IP laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our written permission.

The Service may include links or integrations with third-party services (maps, payment gateways, analytics). We are not responsible for third-party services, and your use of them may be governed by their own terms and policies.
The Service is provided on an “as is” and “as available” basis.
We do not guarantee that listings, garages, auctions, or advertisements are accurate, safe, or reliable.
We do not guarantee uninterrupted or error-free operation of the Apps.
Users and partners are solely responsible for their transactions, services, quality, warranties, and compliance.
To the maximum extent permitted by law:
We will not be liable for indirect, incidental, special, consequential, or punitive damages.
Our total liability for any claim related to the Service will not exceed the amount you paid to us (if any) in the three (3) months before the claim arose, or KWD 10 if you paid nothing.
(Some jurisdictions do not allow certain limitations; in such cases, the limitation applies to the maximum extent permitted.)
You agree to indemnify and hold Garagaty harmless from claims, damages, losses, and expenses (including reasonable legal fees) arising from:
your Content,
your use of the Service,
your violation of these Terms,
your violation of any rights of another party.
We may suspend or terminate your access immediately if:
you violate these Terms,
your activity creates risk to the Service, users, or partners,
required by law or enforcement requests.
You may stop using the Service at any time. Termination does not remove obligations that should survive (payments due, IP, liability limits, indemnity, etc.).
We may update the Service or these Terms from time to time. We will update the “Last Updated” date. Continued use of the Apps after changes means you accept the updated Terms.
These Terms are governed by the laws of the State of Kuwait. Any disputes will be subject to the competent courts in Kuwait, unless applicable law requires otherwise.
